Four years ago the DVD Copy Control Association (DVD CCA) sued Californian Andrew Bunner for posting DeCSS (De-Content Scrambling System) software on the internet. The court that heard that case made an injunction preventing people from posting it.

Now the Sixth Circuit Court of Appeals has overturned this injunction because the judges said it "was an unlawful prior restraint upon Bunner's right to free speech." The lawsuit against Bunner, however, has not been dismissed and the case continues.

DVD CCA had originally argued that DeCSS had trade secrets in CSS technology. The 6th Circuit notes that at the time it was posted, it was on 1,000s of web sites globally. The judges will examine the trade secret issue next.
