The case centered around a 46-year-old club owner who held Texas Hold'em tournaments and took a cut of the prize pool. He was prosecuted under the 1968 Gaming Act. The judge has stated that a small fine and costs should be a sufficient penalty.

During the case his defense attorney argued that poker was indeed a game of skill and required no more luck than chess, golf or other games. Prosecution argued that since cards are shuffled before each hand, the game involves significant luck.
