A trademark infringement lawsuit between Microsoft and Lindows is set to go to trial in April, after a federal judge refused Lindows' motion to throw out the case.
Microsoft says the company, which is offering a Windows-like version of open source OS Linux, is trying to mislead customers by using a name so close to Windows. Although they asked that Lindows be shut down pending trial, the judge refused - twice.
Now a jury must rule whether Microsoft has trademark rights on a word as generic as 'Windows'. http://news.com.com/2100-1001-982098.html?tag=lh
